• If this is your first offense (within 10 years), and you qualify for the Accelerated Rehabilitative Disposition (ARD) Program, there will be no jail time.
  • If this is your first offense (within 10 years), and your BAC is .099% or lower (you did not refuse chemical testing), and you do NOT qualify for ARD (if there is an accident or a child in the car at the time of your arrest you will be excluded from the ARD program), there will be no jail time.
  • If this is your first offense (within 10 years), and your BAC is .10-.159% (you did not refuse chemical testing), and you do NOT qualify for ARD (if there is an accident or a child in the car at the time of your arrest you will be excluded from the ARD program), you will be subject to a minimum of 48 hours jail time.
  • If this is your first offense (within 10 years), and your BAC is .16% or higher OR there are drugs found in your blood (you did not refuse chemical testing), OR you refused chemical testing and you do NOT qualify for ARD (if there is an accident or a child in the car at the time of your arrest you will be excluded from the ARD program), you will be subject to a minimum of 72 hours jail time.

If this is your second or subsequent offense within 10 years, jail time increases exponentially.
